Ramapo Rape Suspect Shooting Case Gets New Grand Jury

 

 

 

 

” Westchester prosecutors will not appeal a judge’s dismissal of charges against David Carlson in the Orange County shooting death of Norris Acosta-Sanchez, a fugitive who was wanted on a statutory rape charge in Ramapo.

  Instead, they will present the case to a new grand jury, a spokesman for the Westchester District Attorney’s Office said Wednesday.

  The indictment was dismissed earlier this month by Judge Robert Freehill, who ruled that an Orange County prosecutor had compromised the integrity of the grand jury presentation by withholding Carlson’s statements about feeling threatened by Acosta-Sanchez’s aggressive movements.

  Carlson shot Acosta-Sanchez in the arm and head with a shotgun on Oct. 11, 2013, while walking him away from his Sparrowbush home. Carlson claims he fired when Acosta-Sanchez lunged at him. “

” After pretrial hearings in August, Ostrer argued that the Orange County prosecutor should have shown the grand jury video of Carlson’s statements. Instead, a state trooper was allowed to recount what Carlson told him and denied Carlson ever claimed the fugitive had lunged at him — even though it was mentioned in the video. “

Ramapo Rape Suspect’s Killer Wants Charges Tossed

 

 

 

 

 

” A murder indictment in last year’s killing of a Ramapo man suspected of rape might not have happened if an Orange County prosecutor had not pushed grand jurors to continue deliberating after their initial vote.

  The lawyer for David Carlson cites that as one example of what he alleges was the prosecutor’s misconduct in the grand jury presentation. He is asking the judge to dismiss the indictment.

” In this case, the presentation was infected with a desire to obtain an indictment,” lawyer Benjamin Ostrer wrote in court papers.

  Carlson had been scheduled to go on trial last month in the Oct. 11, 2013, fatal shooting of Norris Acosta-Sanchez near Carlson’s home in Sparrowbush. But the trial now awaits a ruling by Orange County Judge Robert Freehill on Ostrer’s dismissal motion.

  Ostrer suggested that the prosecutor, Assistant District Attorney Kerry Kolek, coerced grand jurors into charging his client with murder. He also accused her of withholding tapes of Carlson’s statements from the grand jury, relying instead on police testimony that mischaracterized whether Carlson ever claimed to have shot Acosta-Sanchez because the fugitive lunged at him.”

Oct 24 Orange County grand jury indicts David Carlson

An Orange County grand jury hands up an indictment for the Sparrowbush man accused of shooting and killing another man wanted for rape. YNN’s Meredith Zaritheny reports.

ORANGE COUNTY, N.Y. — A Sparrowbush man accused of shooting a fugitive rape suspect outside his home is indicted on a number of charges.

Now, David Carlson is out on bail and fighting to clear his name.

Carlson is charged with second degree murder, manslaughter, criminally negligent homicide, and criminal possession of a weapon.

Prosecutors say Carlson shot unarmed Norris Acosta-Sanchez, with a 12-gauge shotgun in the head on October 11 of this year.

Police had been searching for Acosta-Sanchez. They say when Carlson tried to detain Acosta-Sanchez until authorities could arrive, he shot and killed him.

Carlson will be arraigned next week.

“Very concerned I’m looking at some serious charges. It’s not just about me; it’s about my sons and my wife. I have to be here to be a father not just financially but emotionally,” said Carlson.

If convicted, Carlson faces up to 25 years to life in prison.

” Accused murderer David Carlson, of Sparrowbush, was released from jail today, one week after allegedly shooting a fugitive wanted for rape.

“I’m feeling good,” he said. “Glad I got decent bail and glad to be home with my family.”

Carlson is charged with killing rape suspect Norris Acosta-Sanchez. Acosta-Sanchez, 35, was wanted for allegedly raping a girl under the age of 15 and had been on the run for months, evading police capture at least twice before Carlson allegedly killed him last Friday.”

 

 

 

 

 

 

 

 

 

 

 

 

Notice Of Indictment In Sparrowbush Shooting Case

 

 

 

” Orange County District Attorney Frank Phillips announced Thursday afternoon that a grand jury has voted to indict David Carlson, 42, of Sparrowbush, on criminal charges in the fatal shooting of Rockland County rape suspect Norris Acosta-Sanchez, 35.

“Until a formal indictment is filed in Orange County Court, either next Tuesday or Thursday, we cannot disclose the crime or crimes with which the defendant has been charged. Grand Jury proceedings are secret and we cannot comment on what witnesses appeared, the charges considered, or any other aspect of the Grand Jury action,” Phillips wrote in a formal statement issued via email.

Carlson is currently being held without bail at Orange County Jail. Local-court judges cannot set bail in class A felony cases.
Phillips said Carlson’s lawyer may seek to ask a County Court judge to set bail, and that could happen by Friday.”

New York Father Charged With Murder For Shooting Death Of Wanted Rape Suspect

” An Orange County, New York father of three has been charged with second-degree murder after he shot and killed a 35-year-old man wanted by authorities for the alleged rape of an underage girl this past summer.

The shooting incident, which happened Friday, followed an intense search for the suspect by authorities and, according to the Times Herald-Record, has left area residents questioning why the suspect returned to the area after his escape and why the man, who some say was protecting his family, is now facing murder charges.

Ramapo Detective Sgt. John Lynch told local media that they had been searching for Norris Acosta-Sanchez since July when the girl’s parents discovered and reported the rape. Acosta-Sanchez had been indicted by a Rockland County grand jury for felony second-degree rape and second-degree criminal sexual act and a misdemeanor count of endangering the welfare of a child. 

Details of what led up to the shooting have not been made available, but Carlson, who neighbors describe as a “really good man” who is kindhearted and generous, has been charged with second-degree murder, a decision that not all of the residents of the small town are happy about.”
